EULA (Licensed Application End User License Agreement) for Android users
By using Brightmind Pro on Android, you agree to this End User License Agreement.
This End User License Agreement ("Agreement") is a binding legal agreement between you ("User" or "you") and SalesFactory B.V. ("Company," "we," or "us"). By downloading, installing, or using Brightmind Pro (the "Application"), you agree to be bound by the terms of this Agreement.
1. Grant of License
The Application is licensed, not sold, to you. Subject to your compliance with this Agreement, we grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application strictly in accordance with these terms for your personal, non-commercial use on an Android device owned or controlled by you.
2. Subscription Terms & Billing
The Application is free to download but requires a paid subscription for full functionality.
Recurring Billing: By starting a subscription, you authorize us (or one of our third-party processor, Google Play or Stripe) to charge the applicable subscription fee at the then-current rate. Subscriptions automatically renew at the end of each billing cycle unless canceled.
Free Trials: If a free trial is offered, it will transition into a paid subscription at the end of the trial period. To avoid charges, you must cancel at least 24 hours before the trial ends.
Cancellation: You may cancel your subscription at any time. For Android users, this must be done through the Google Play Store subscription settings or from inside the app depending on how you initially subscribed. Access to the Application features will remain active until the end of the current billing period. No refunds are provided for partial months.
3. Restrictions on Use
You agree not to, and you will not permit others to:
No Reverse Engineering: Decompile, reverse engineer, disassemble, or attempt to derive the source code of the Application.
No Redistribution: Rent, lease, lend, sell, redistribute, or sublicense the Application.
Intellectual Property: Use the Application for any purpose that infringes on the Company’s intellectual property rights or those of third parties.
4. Termination
This Agreement is effective until terminated by you or the Company.
Cause: We may terminate or suspend your access immediately, without prior notice, for conduct that we believe violates this Agreement or for failure to pay subscription fees.
Effect: Upon termination, the license granted to you will cease. You must immediately stop all use of the Application and delete all copies from your devices.
5. Limitation of Liability & Warranty Disclaimer
"As Is" Basis: The Application is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, express or implied. We do not warrant that the Application will be error-free or uninterrupted.
Liability Cap: To the maximum extent permitted by law, the Company’s total financial responsibility to you for any claims arising out of this Agreement shall be limited to the amount you paid for the subscription in the twelve (12) months preceding the claim.
6. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts located in the Netherlands.
